2525 An Act relative to drug prices paid by carriers.
2626 Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
2727 enhance the provision of medical services in the commonwealth, therefore it is hereby declared
2828 to be an emergency law, necessary for the immediate preservation of the public health.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Notwithstanding the provisions of any general or special law or regulation
3232 2to the contrary, the division of insurance and the health policy commission shall promulgate
3333 3regulations with the goal of ensuring that carriers, as defined in section 1 of chapter 6D of the
3434 4General Laws, shall not pay more for drugs than the lowest price paid under any program
3535 5overseen by the federal Centers for Medicare and Medicaid Services.
