| 26 | 26 | | Whereas, The deferred operation of this act would tend to defeat its purpose, which is to |
|---|
| 27 | 27 | | enhance the provision of medical services in the commonwealth, therefore it is hereby declared |
|---|
| 28 | 28 | | to be an emergency law, necessary for the immediate preservation of the public health. |

| 29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 30 | 30 | | of the same, as follows: |

| 31 | 31 | | 1 SECTION 1. Notwithstanding the provisions of any general or special law or regulation |
|---|
| 32 | 32 | | 2to the contrary, the division of insurance and the health policy commission shall promulgate |
|---|
| 33 | 33 | | 3regulations with the goal of ensuring that carriers, as defined in section 1 of chapter 6D of the |
|---|
| 34 | 34 | | 4General Laws, shall not pay more for drugs than the lowest price paid under any program |
|---|
| 35 | 35 | | 5overseen by the federal Centers for Medicare and Medicaid Services. |
