[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 1348 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to instate tuition. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1: 2 (a) Section 9 of chapter 15A of the General Laws is hereby amended by adding the 3following paragraph:— 4 Notwithstanding any general or special law to the contrary, for the purpose of 5determining eligibility for in-state tuition rates and fees at public institutions of higher education, 6in the case of an individual who is not a citizen or permanent resident of the United States as 7those terms are defined under federal immigration law, the individual shall not be eligible for in- 8state tuition. 2 of 2 9 (b) Subsection (t) of Section 9 of chapter 15A of the General Laws is hereby further 10amended striking out subsection (t), and inserting in place thereof the following subsection:— 11 (t) issue regulations defining resident of the commonwealth and proof of the same for the 12purpose of admission and tuition expenses of public institutions of higher education and prepare 13uniform proofs of residence to be used by all public institutions; provided, however, for the 14purposes of this clause, a resident of the commonwealth shall also be a citizen or permanent 15resident of the United States, as provided in section 1621 of Title 8 of the United States Code; 16provided further, that insofar as the Massachusetts Maritime Academy is designated a regional 17maritime academy by the United States maritime administration, residents of the states 18comprising the designated region and attending the Massachusetts Maritime Academy shall be 19considered Massachusetts residents for the purposes of admission and tuition;
