2828 An Act relative to law enforcement access to prescription monitoring data.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Clause (4) of subsection (f) of section 24A of chapter 94C of the General
3232 2Laws, inserted by section 42 of chapter 208 of the acts of 2020, is hereby amended by striking
3333 3out the words “and accompanied by a probable cause warrant issued pursuant to chapter 276”.
3434 4 SECTION 2. Said subsection (f) of said section 24A of said chapter 94C is hereby further
3535 5amended by striking out clause (6), as appearing in chapter 425 of the acts of 2020, and inserting
3636 6in place thereof the following clause:-
3737 7 (6) personnel of: (A) the United States attorney or a federal agency; provided, however,
3838 8that the data request is made pursuant to clause (4) or federal law; (B) the office of the attorney
3939 9general provided, however, that the data request is in connection with a bona fide specific 2 of 2
4040 10controlled substance or additional drug-related investigation; or (C) a district attorney’s office;
4141 11provided, however, that the data request is in connection with a bona fide specific controlled
4242 12substance or additional drug-related investigation;
