2828 An Act updating Nicky’s Law to protect individuals with disabilities in MassHealth day
2929 habilitation programs.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Section 15 of Chapter 19C of the General Laws, as appearing in the 2020 is
3333 2hereby amended by striking the definition for “employer” and inserting in place thereof the
3434 3following definition:-
3535 4 “Employer”, an entity that provides services or treatment to persons with intellectual or
3636 5developmental disabilities pursuant to (i) a contract or agreement with the department; (ii)
3737 6funding administered by the department; (iii) a license issued pursuant to section 15 or 15A of
3838 7chapter 19B; or (iv) a contract with MassHealth to provide day habilitation services subject to
3939 8130 CMR 419.000.
