29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. This act may be cited as the "Free Flow of Information Act." |
---|
32 | 32 | | 2 SECTION 2. Chapter 233 of the General Laws , as appearing in the 2012 Official |
---|
33 | 33 | | 3Edition, is hereby amended by adding the following section:- |
---|
34 | 34 | | 4 Section 84. (a) For the purposes of this section, the following terms shall have the |
---|
35 | 35 | | 5following meanings:- |
---|
36 | 36 | | 6 "Covered person", any person who is or has been an employee, agent, or independent |
---|
37 | 37 | | 7contractor of any news media as defined here, and who, for gain, is or has been regularly |
---|
38 | 38 | | 8engaged in bona fide news gathering for such entity, and who obtained or prepared the news or |
---|
39 | 39 | | 9information that is sought while serving in that capacity. 2 of 4 |
---|
40 | 40 | | 10 "News or information", written oral, pictorial, photographic or electronically recorded |
---|
41 | 41 | | 11information or communication concerning local, national, or worldwide events, or other matters |
---|
42 | 42 | | 12of public concern or public interest. |
---|
43 | 43 | | 13 "News media", any newspaper, magazine or other periodical, book publisher, news |
---|
44 | 44 | | 14agency, wire service, press association, radio or television station or network, cable or satellite |
---|
45 | 45 | | 15station or network, or audio or audiovisual production company, college and university affiliated |
---|
46 | 46 | | 16and sanctioned student press, or any entity that is in the regular business of gathering and |
---|
47 | 47 | | 17disseminating news or information to the public by any means, including, but not limited to, |
---|
48 | 48 | | 18print, broadcast, photographic, mechanical, internet, or electronic distribution. |
---|
49 | 49 | | 19 (b) (1) Except as provided in subsection (c), no entity of the judicial, legislative or |
---|
50 | 50 | | 20executive branch of the commonwealth with the power to issue a subpoena or provide other |
---|
51 | 51 | | 21compulsory process shall compel any covered person, who is providing or has provided services |
---|
52 | 52 | | 22for the news media to disclose: |
---|
53 | 53 | | 23 (i) the source of any news or information procured by such covered person, or any |
---|
54 | 54 | | 24information that would tend to identify such source, while providing services for the news media, |
---|
55 | 55 | | 25whether or not such source has been promised confidentially: or |
---|
56 | 56 | | 26 (ii) any news or information procured by the covered person, while providing services for |
---|
57 | 57 | | 27the news media, that is not itself communicated in the news media, including any: notes; |
---|
58 | 58 | | 28outtakes; photographs or photographic negatives; video or sound tapes; film or; other data, |
---|
59 | 59 | | 29irrespective of its nature, that is not itself communicated in the news media. 3 of 4 |

60 | 60 | | 30 (2) The protection from compelled disclosure described in subparagraph (1) shall apply to |
---|
61 | 61 | | 31a supervisor or employer, including a subsidiary, parent or affiliate company of employer, or any |
---|
62 | 62 | | 32person assisting a covered person to whom said sub paragraph (1) applies. |
---|
63 | 63 | | 33 (3) Any news or information obtained in violation of this section shall be inadmissible in |
---|
64 | 64 | | 34any action, proceeding or hearing before any entity of the judicial legislative or executive branch |
---|
65 | 65 | | 35of the commonwealth. |
---|
66 | 66 | | 36 (c) A state entity may not compel a covered person to testify or produce any document in |
---|
67 | 67 | | 37any proceeding or in connection with any issue arising under state law unless: |
---|
68 | 68 | | 38 (i) disclosure of the identity of a source is critical and necessary to prevent imminent |
---|
69 | 69 | | 39harm to public safety; |
---|
70 | 70 | | 40 (ii) compelled disclosure of the identity of a source would prevent such harm; and |
---|
71 | 71 | | 41 (iii) the harm sought to be redressed by requiring disclosure outweighs the public interest |
---|
72 | 72 | | 42in protecting the free flow of information. |
---|
73 | 73 | | 43 (d)(1) A court may compel disclosure of news or information described in clause (ii) of |
---|
74 | 74 | | 44paragraph (1) of subsection (b) and protected from disclosure under said subsection (b) if the |
---|
75 | 75 | | 45court finds, after providing notice and an opportunity to be heard to the person or entity from |
---|
76 | 76 | | 46whom the news or information is sought, that the party seeking the news or information has |
---|
77 | 77 | | 47established by clear and convincing evidence that: |
---|
78 | 78 | | 48 (i) the news or information is critical and necessary to the resolution of a significant legal |
---|
79 | 79 | | 49issue before an entity of the judicial, legislative or executive branch of the commonwealth that |
---|
80 | 80 | | 50has the power to issue a subpoena; 4 of 4 |

81 | 81 | | 51 (ii) the news or information could not reasonably be obtained by alternative means; |
---|
82 | 82 | | 52 (iii) there is an overriding public interest in the disclosure; and |
---|
83 | 83 | | 53 (iv) the party has attempted prior negotiations with the covered person or news media. |
---|
84 | 84 | | 54 (2) A court may not compel disclosure of the source of any news or information |
---|
85 | 85 | | 55described in clause (i) of paragraph (1) of subsection (b) and protected from disclosure under |
---|
86 | 86 | | 56said subsection (b). |
---|
87 | 87 | | 57 (e) The publication by the news media or the dissemination by a covered person while |
---|
88 | 88 | | 58providing services for the news media of a source of news or information, or a portion of the |
---|
89 | 89 | | 59news or information, procured in the course of pursuing professional activities shall not |
---|
90 | 90 | | 60constitute a waiver of the protection from compelled disclosure that is described in subsection |
---|
91 | 91 | | 61(b). |
