29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |

31 | 31 | | 1 Section 10A of Chapter 269 of the Massachusetts General Laws is hereby amended by |
---|
32 | 32 | | 2deleting the section in its entirety and inserting in its place the following: |

33 | 33 | | 3 Section 10A. |

34 | 34 | | 4 Any person found to be in possession of a firearm suppressor who is: |
---|
35 | 35 | | 5 (a)a prohibited person under section 131 of chapter 140; |
---|
36 | 36 | | 6 (b)in the commission of a violent crime or felony; |
---|
37 | 37 | | 7 (c)in the commission of a crime of violence against a family member; 2 of 2 |
---|
38 | 38 | | 8 (d)conducting sales or has possession of controlled substances as defined in chapter |
---|
39 | 39 | | 994C; |
---|
40 | 40 | | 10 shall be punished by imprisonment for not more than ten years in state prison or for not |
---|
41 | 41 | | 11more than two and one-half years in a jail or house of correction. |
---|
42 | 42 | | 12 The term “firearm suppressor” or “firearm noise reduction device” means any device for |

43 | 43 | | 13muffling or diminishing the report of a portable firearm, including any combination of parts, |

44 | 44 | | 14designed or redesigned, and intended for use in assembling or fabricating a firearm muffler, and |

45 | 45 | | 15any part intended only for use in such assembly or fabrication. For the purposes of this section |

46 | 46 | | 16the term “firearm suppressor” or “firearm noise reduction device” shall have the same meaning |
---|
47 | 47 | | 17as Federal Law 18 USC 921(24). |
