| 28 | 28 | | of the same, as follows: |

| 29 | 29 | | 1 SECTION 1. Chapter 265 of the General Laws, as appearing in the 2020 Official Edition, |
|---|
| 30 | 30 | | 2is hereby amended by inserting after section 48 the following new section: |
|---|
| 31 | 31 | | 3 Section 48A. A sex offender who has been finally classified as a level 3 sex offender |
|---|
| 32 | 32 | | 4shall be prohibited from renting, residing, or otherwise occupying a single-family dwelling or a |
|---|
| 33 | 33 | | 5unit in a multi-family dwelling with another finally classified level 3 sex offender, regardless of |
|---|
| 34 | 34 | | 6the permanent or temporary residential status of either sex offender, unless those persons are |
|---|
| 35 | 35 | | 7legally related by consanguinity, affinity or adoption. |
|---|
| 36 | 36 | | 8 A sex offender who violates this section shall be punished by a fine of $1,000 or |
|---|
| 37 | 37 | | 9imprisonment in a house of correction for not more than 2 ½ years, or both such fine and |
|---|
| 38 | 38 | | 10imprisonment. Written notification shall be made to the sex offender registry board of such |
|---|
| 39 | 39 | | 11violation. |
