31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
32 | 32 | | of the same, as follows: |
---|
33 | 33 | | 1 SECTION 1. The commissioner of probation is hereby authorized and directed to include |
---|
34 | 34 | | 2any injunction issued, whether a temporary, preliminary, permanent or final injunction, pursuant |
---|
35 | 35 | | 3to sections 11H or section 11I of chapter 12, or section 127B of chapter 266, in the statewide |
---|
36 | 36 | | 4domestic violence record keeping system created pursuant to St. 1992, c. 188 § 7. Such |
---|
37 | 37 | | 5information shall be made available to judges considering the issuance of any injunction |
---|
38 | 38 | | 6pursuant to sections 11H or 12I of chapter 12, or section 127B of chapter 266. Further, such |
---|
39 | 39 | | 7information shall be made available to criminal justice agencies through the criminal justice |
---|
40 | 40 | | 8information system maintained by the executive office of public safety. 2 of 2 |

41 | 41 | | 9 SECTION 2. Section 11H of chapter 12 of the General Laws is hereby amended by |
---|
42 | 42 | | 10inserting after the second sentence the following sentences:— |
---|
43 | 43 | | 11 Upon issuance of an injunction, whether a final injunctive order, or a temporary, |
---|
44 | 44 | | 12preliminary, or permanent injunction, as provided in this section, the clerk shall transmit a |
---|
45 | 45 | | 13certified copy of such order to the commissioner of probation for entry into the statewide |
---|
46 | 46 | | 14domestic violence record keeping system. The Attorney General shall transmit to the |
---|
47 | 47 | | 15commissioner of probation a certified copy of each order obtained under this section that is in |
---|
48 | 48 | | 16effect on the effective date of this amendment, for entry into the statewide domestic violence |
---|
49 | 49 | | 17record keeping system. |
---|
50 | 50 | | 18 SECTION 3. Section 11I of chapter 12 of the General Laws is hereby amended by |
---|
51 | 51 | | 19inserting after the second sentence the following sentence:— |
