2525 An Act to improve after hours bail procedures.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Section 24 of Chapter 262 of the General Laws as appearing in the 2018
2929 2Official Edition is hereby amended by striking out the first paragraph and inserting in place
3030 3thereof the following paragraph:-
3131 4 (a) Subject to appropriation, the Trial Court shall be responsible for compensation to
3232 5persons authorized to take bail outside of regular working hours pursuant to this section.
3333 6 SECTION 2. Section 24 of Chapter 262 of the General Laws as appearing in the 2018
3434 7Official Edition is further amended by striking out the second paragraph.
3535 8 SECTION 3. Section 24 of Chapter 262 of the General Laws as appearing in the 2018
3636 9Official Edition is further amended by striking out the third paragraph and inserting in place
3737 10thereof the following paragraph:- (b) Persons authorized to take bail may administer though wire
3838 11or electronic means any oath or affirmation required in the course of taking bail or releasing on 2 of 2
3939 12personal recognizance. No person authorized to take bail shall delegate the setting or taking of
4040 13bail or the setting or taking of release on personal recognizance to any other person.
