2626 An Act making technical changes to the laws regulating a certain notarial act.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 183 of the General Laws is hereby amended by striking out section
3030 242 and inserting in place thereof the following new section:
3131 3 Section 42. The forms set forth in the appendix to this chapter and in section 15 of
3232 4chapter 222 for taking acknowledgments to deeds and other instruments and for certifying the
3333 5authority of officers taking proofs or acknowledgments may be used but the existence of those
3434 6forms shall not preclude the use of any other forms lawfully used as required or authorized by
3535 7any general or special law or any regulation or executive order regulating notaries public,
3636 8including forms that acknowledge the act of an individual executing a document in a
3737 9representative capacity but fail to acknowledge the deed or instrument as the act of the principal
3838 10or grantor.
3939 11 SECTION 2. Section 1 of chapter 222 of the General Laws is hereby amended by striking
4040 12out the definition of “Acknowledgment” and inserting in place thereof the following: 2 of 3
4141 13“Acknowledgment”, a notarial act in which an individual, at a single time appears, in person,
4242 14before a notary public, is identified by the notary public through satisfactory evidence of identity
4343 15and presents a document to the notary public and indicates that the individual has executed the
4444 16document for the purposes stated therein, and, if applicable, that the individual was authorized to
4545 17sign in a particular representative capacity and did so as the act of the person or entity stated
4646 18therein.
4747 19 SECTION 3. Section 15 of said chapter 222 is hereby amended by striking out subsection
4848 20(b) and inserting in place thereof the following subsection:
4949 21 (b) A notary public shall take the acknowledgment of the signature or mark of persons
5050 22acknowledging for themselves or in any representative capacity by using substantially the
5151 23following form:
5252 24 “On this ____ day of ___________, 20__, before me, the undersigned notary public,
5353 25________________________ (name of document signer) personally appeared, proved to me
5454 26through satisfactory evidence of identification, which were _______________________, to be
5555 27the person whose name is signed on the preceding or attached document, and acknowledged to
5656 28me that (he) (she) signed it for its stated purpose.
5757 29 (as partner for ____________, a partnership)
5858 30 (as ____________ for ______________, a corporation or other entity)
5959 31 (as attorney in fact for ________________, the principal)
6060 32 (as ___________ for _______________, (a) (the) _________________)

6363 35 SECTION 4. Section 20 of said chapter 222 is hereby amended by removing the words
6464 36“voluntary or free” from the third numbered paragraph of subsection (b).
6565 37 SECTION 5. Form 13, as set forth in the appendix to chapter 183 of the General Laws, is
6666 38hereby amended by removing the word “free.”
6767 39 SECTION 6. Form 14, as set forth in the appendix to chapter 183 of the General Laws, is
6868 40hereby amended by removing the word “free.”
6969 41 SECTION 7. Form 15, as set forth in the appendix to chapter 183 of the General Laws, is
