2525 An Act relative to plant medicine.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 94C of the General Laws, as so appearing in the 2020 Official
2929 2Edition, is hereby amended by inserting after section 49 the following new section-:
3030 3 Section 50: Entheogenic Plants and Fungi
3131 4 Notwithstanding any general or special law to the contrary, all of the following shall be
3232 5lawful for a natural person 18 years of age or older and shall not be a violation of state or local
3333 6law: the possession, ingestion, obtaining, growing, giving away without financial gain to natural
3434 7persons 18 years of age or older, and transportation of no more than two grams of psilocybin,
3535 8psilocyn, dimethyltryptamine, ibogaine, and mescaline, excluding the weight of any material
3636 9such as water, plant, and fungi material of which the substance is a part or to which the substance
3737 10is added, dissolved, held in solution, or suspended.
3838 11 “Financial gain” shall mean the receipt of money or other valuable consideration in
3939 12exchange for the item being shared.
