2828 An Act relative to studying the establishment of a statewide registry of persons convicted for the
2929 sale or trafficking of certain class A drugs.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. There is hereby established a special commission to make recommendations
3333 2on the establishment of a statewide registry of persons who are convicted for the sale and/or
3434 3trafficking of a class A substance, as defined in section 31 of chapter 94C of the General Laws,
3535 4as appearing in the 2020 Official Edition. The report shall include, but not be limited to findings
3636 5and recommendations regarding:
3737 6 (a) the scope of criminal offenses appropriate for registration, the classification of
3838 7persons convicted of such offenses, and judicial review thereof; (b) the due process interests of
3939 8persons who are subject to registration; (c) the public interest in disseminating information
4040 9regarding narcotics dealers to the general public; (d) the sharing of registration information
4141 10between certain law enforcement agencies; (e) special considerations regarding homeless
4242 11individuals and juveniles; (f) the term of registration that should be required; (g) penalties for 2 of 2
4343 12persons who fail to register; (h) fees for registration; (i) policies regarding the use,
4444 13confidentiality, and misuse of registration information; and, (j) the establishment and
4545 14administration of a board to oversee the creation and continued operation of the registry.
4646 15 SECTION 2. The commission shall consist of the following 13 members: the secretary of
4747 16public safety and security, who shall serve as chair; the attorney general or a designee; the chief
4848 17counsel of the committee for public counsel services or a designee; a representative of the
4949 18Massachusetts District Attorneys Association or a designee; 3 members appointed by the
5050 19president of the Senate, at least one of whom shall be a member of the minority party; and, 3
5151 20members appointed by the Speaker of the House of Representatives, at least one of whom shall
5252 21be a member of the minority party. The commission may consider input from any relevant
5353 22organization.
5454 23 SECTION 3. The commission shall file a report of its findings and recommendations,
5555 24together with drafts of legislation necessary to carry those recommendations into effect, with the
5656 25clerks of the house of representatives and the senate, the joint committee on the judiciary, and the
5757 26joint committee on public safety and homeland security not later than 9 months following the
5858 27effective date of this act.
