2828 An Act uplifting families and securing the right to strike for certain public employees.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 9 of chapter 150E of the General Laws, as appearing in the 2020
3232 2Official Edition, is hereby amended by striking out, in line 1, the words “a reasonable period”
3333 3and inserting in place thereof the following words:- 6 months.
3434 4 SECTION 2. Said section 9 of chapter 150E, as so appearing, is hereby further amended
3535 5by inserting, in line 19, after the word “mediation” the following words:- not to exceed 6 months.
3636 6 SECTION 3. Said section 9 of chapter 150E, as so appearing, is hereby further amended
3737 7by striking out, in line 22, the words “If the impasse continues after the conclusion of mediation,
3838 8either” and inserting in place thereof the following word:- Either.
3939 9 SECTION 4. Said section 9 of chapter 150E, as so appearing, is hereby further amended
4040 10by inserting at the end thereof the following paragraph:- The provisions of section 9A of this 2 of 2
4141 11chapter shall not apply once a petition for a determination of the existence of an impasse is filed
4242 12under this section, unless the negotiation pertains to public safety employees.
4343 13 SECTION 5. Said chapter 150E, as so appearing, is hereby further amended in section
4444 149A by striking out the first paragraph and inserting in place thereof the following paragraph:-
4545 15 (a) No public safety employee or public safety employee organization, or any other
4646 16public employee or public employee organization prior to 6 months of negotiation over the terms
4747 17of a collective bargaining agreement pursuant to section 9, shall engage in a strike, work
4848 18stoppage, slowdown or withholding of services by such public employees.
