29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. Chapter 149 of the General Laws is hereby amended by inserting after |
---|
32 | 32 | | 2section 105D the following section:- |
---|
33 | 33 | | 3 Section 105E. (a) As used in this section, the following words shall have the following |
---|
34 | 34 | | 4meanings: |
---|
35 | 35 | | 5 “covered employer” shall mean any employer, public or private, that employs 15 or more |
---|
36 | 36 | | 6employees in Massachusetts. |
---|
37 | 37 | | 7 “pay range” shall mean the annual salary range or hourly wage range or other |
---|
38 | 38 | | 8compensation that the employer reasonably and in good faith expects to pay for such position at |
---|
39 | 39 | | 9that time. |
---|
40 | 40 | | 10 (b) A covered employer, or agent of said employer, shall disclose the pay range for a |
---|
41 | 41 | | 11particular employment position within the advertising or posting of the position. 2 of 2 |

42 | 42 | | 12 (c) A covered employer, or agent of said employer, shall provide the pay range for a |
---|
43 | 43 | | 13particular employment position to an employee offered a promotion or a transfer to a new |
---|
44 | 44 | | 14position. |
---|
45 | 45 | | 15 (d) A covered employer, or agent of said employer, shall provide the pay range for a |
---|
46 | 46 | | 16particular employment position to an employee holding such position, or to an applicant for such |
---|
47 | 47 | | 17position, upon request. |
---|
48 | 48 | | 18 (e) It shall be an unlawful practice for any employer to discharge or in any other manner |
---|
49 | 49 | | 19retaliate or discriminate against any employee or applicant because such employee or applicant |
---|
50 | 50 | | 20has opposed any act or practice made unlawful by this section, or has made any complaint to his |
---|
51 | 51 | | 21employer, the attorney general, or any other person, or instituted, or caused to be instituted, any |
---|
52 | 52 | | 22proceeding under or related to this section, or has testified or is about to testify in any such |
---|
53 | 53 | | 23proceeding. |
---|
54 | 54 | | 24 (f) The Attorney General shall enforce this section and may obtain injunctive or |
---|
55 | 55 | | 25declaratory relief for this purpose. Any covered employer who violates this section, including |
---|
56 | 56 | | 26failure to disclose a good-faith pay range, shall be punished by a warning for the first offense and |
---|
57 | 57 | | 27not more than $500 for the second offense. For a third or subsequent offense, violation of this |
---|
58 | 58 | | 28section shall be subject to section 27C(b)(1) and (2) of chapter 149. No violation of this section |
---|
59 | 59 | | 29shall be construed to carry treble damages in chapter 149 section 150. |
---|
60 | 60 | | 30 (g) The Attorney General shall conduct a public awareness outreach campaign, which |
---|
61 | 61 | | 31shall include, but not be limited to, making information available on its website and otherwise |
---|
62 | 62 | | 32informing employers of the provisions of this section. |
