2626 An Act relative to the Department of Unemployment Assistance Advisory Council.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Section 9N of chapter 23 of the General Laws, as appearing in the 2020
3030 2Official Edition, is hereby amended by striking out the first paragraph and inserting in place
3131 3thereof the following paragraph:-
3232 4 (a) There shall be in the department of unemployment assistance, but not subject to the
3333 5control of the director of unemployment assistance, a state advisory council of seven members
3434 6appointed by the governor, including at least 1 member from each list of nominees submitted by
3535 7the following organizations: the Associated Industries of Massachusetts, the Massachusetts
3636 8AFL–CIO, the Massachusetts Legal Assistance Corporation, and the Retailers Association of
3737 9Massachusetts. The governor shall from time to time designate one of the members as chairman.
3838 10Of the members originally appointed, two members shall be chosen for a term of four years, and
3939 11the remaining members shall be chosen for a term of six years; and thereafter as their terms
4040 12expire the governor shall appoint members for terms of six years. Vacancies shall be filled by 2 of 2
4141 13appointment by the governor, with like advice and consent, for the remainder of the unexpired
4242 14term, except that if the governor fails to fill such vacancy within sixty days after such vacancy
4343 15exists, such vacancy shall be filled forthwith by a majority vote of all the remaining members of
4444 16the advisory council for the remainder of the unexpired term. All members shall serve until the
4545 17qualification of their respective successors. The council shall meet at least six times a year. Each
4646 18of the members of the council shall receive the sum of one hundred dollars as compensation for
4747 19each day's attendance at meetings of the council; provided, that the total amount paid hereunder
4848 20to any such member shall not exceed three thousand dollars in any calendar year. Members of
4949 21the council shall receive their traveling and other necessary expenses incurred in the performance
5050 22of their duties. The director of unemployment assistance shall provide for the council suitable
5151 23meeting quarters and such clerical and other assistance as the council may deem necessary. Said
5252 24offices and the incumbents thereof shall not be subject to chapter thirty-one and the rules and
5353 25regulations made thereunder.
5454 26 SECTION 2. Said section 9N of said chapter 23 is hereby further amended by inserting
5555 27after the last paragraph the following paragraph:-
5656 28 (c) The state advisory council shall be subject to sections 18 through 25, inclusive, of
5757 29chapter 30A of the general laws.
5858 30 SECTION 3. Section 62 of chapter 151A of the General Laws is hereby amended by
5959 31striking out, in line 28, the words “commerce and labor”, and inserting in place thereof the
6060 32following words:- labor and workforce development
