28	28	An Act to increase contributions to the Workforce Competitiveness Trust Fund.
29	29	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
30	30	of the same, as follows:
31	31	1 SECTION 1. Section 2WWW of chapter 29 of the General Laws, as appearing in the
32	32	22020 Official Edition, is hereby amended by striking out subsection (d) and inserting in place
33	33	3thereof the following subsection:-
34	34	4 (d) There shall be credited to the fund amounts as detailed in section 14L1/2 of chapter
35	35	5151A, and any gifts, grants, private contributions, investment income earned on the fund's assets,
36	36	6and all other sources. Money remaining in the fund at the end of a fiscal year shall not revert to
37	37	7the General Fund.
38	38	8 SECTION 2. Section 14L of chapter 151A of the General Laws, as appearing in the 2020
39	39	9Official Edition, is hereby amended by inserting after subsection (b) the following subsection:- 2 of 3
40	40	10 (c) Not later than March 1 of each year, the commissioner shall file a report in writing
41	41	11with the joint committee on labor and workforce development and the house and senate
42	42	12committees on ways and means concerning the collection of the workforce training
43	43	13contributions, pursuant to subsection (a), during the calendar year ending on the preceding
44	44	14December 31, which shall include, but not be limited to: (1) the amount collected in each quarter
45	45	15and the total amount collected for the year; (2) the total number of employers that contributed to
46	46	16the fund, and the total number of employees employed by this group of employers; and (3) the
47	47	17contribution rate, to the extent it differs from 0.056 per cent.
48	48	18 SECTION 3. Said chapter 151A, as so appearing, is hereby further amended by inserting
49	49	19after section 14L the following section:-
50	50	20 Section 14L1/2. (a) Each employer liable to pay a contribution under subsection (i) of
51	51	21section 14 shall also pay, in the same manner and at the same times as the commissioner
52	52	22prescribes for the contribution required by said section 14, a workforce competitiveness trust
53	53	23fund contribution. For an employer’s first through nineteenth employee, inclusive, the
54	54	24contribution shall be 0.028 per cent of so much of its wages as are subject to contributions
55	55	25pursuant to clause (4) of subsection (a) of said section 14. For an employer’s twentieth through
56	56	26one-hundredth employee, inclusive, the contribution shall be 0.042 per cent of so much of its
57	57	27wages as are subject to contributions pursuant to clause (4) of subsection (a) of said section 14.
58	58	28For an employer’s one hundred and first employee and any employee thereafter, the contribution
59	59	29shall be 0.056 per cent of so much of its wages as are subject to contributions pursuant to clause
60	60	30(4) of subsection (a) of said section 14. The commissioner shall deposit the proceeds of said
61	61	31workforce competitiveness trust fund contribution in the Workforce Competitiveness Trust Fund,
62	62	32established by section 2WWW of chapter 29. 3 of 3
63	63	33 (b) Except where inconsistent with the provisions of this section, the terms and conditions
64	64	34of this chapter that apply to the payment of and the collection of contributions shall apply to the
65	65	35same extent to the payment of and the collection of the workforce competitiveness trust fund
66	66	36contribution required by this section; provided, however, that said contributions shall not be
67	67	37credited to the employer’s account or the solvency account established pursuant to section 14,
68	68	3814A or 14C.
69	69	39 (c) Not later than March 1 of each year, the commissioner shall file a report in writing
70	70	40with the joint committee on labor and workforce development and the house and senate
71	71	41committees on ways and means concerning the collection of the workforce competitiveness trust
72	72	42fund contributions, pursuant to subsection (a), during the calendar year ending on the preceding
73	73	43December 31, which shall include, but not be limited to: (1) the amount collected in each quarter
74	74	44and the total amount collected for the year; and (2) the total number of employers that
75	75	45contributed to the fund, and the total number of employees employed by this group of employers.
