2626 An Act relative to fairness in workers' compensation benefits.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 152 of the General Laws, as appearing in the 2020 Official Edition,
3030 2is hereby amended by striking out section 27 in its entirety and inserting in place thereof the
3131 3following:-
3232 4 Section 27. If the employee is injured by reason of his serious willful misconduct,
3333 5including intoxication or unlawful use of a controlled substance, as defined in section 1 of
3434 6chapter 94C, he shall not receive compensation or any portion of the benefit; provided, that this
3535 7provision shall not bar compensation or benefits to his or her dependents if the injury results in
3636 8death.
