2727 An Act relative to commission sales rates.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. There shall be a special task force to review and report on the economic
3131 2impact of sales commission rate structures to ensure fairness, transparency, and equality in the
3232 3payment for commissioned workers in the Commonwealth. The task force shall consist of 9
3333 4members: the house and senate chairs of the joint committees on labor and workforce
3434 5development economic development and emerging technologies, or their designees, who shall
3535 6serve as the co-chairs of the task force; a member of the general court appointed by the senate
3636 7minority leader; a member of the general court appointed by the house minority leader; the
3737 8executive director of the Massachusetts Workforce Development Board, or a designee; the
3838 9Massachusetts attorney general, or a designee; and 3 persons to be appointed by the secretary of
3939 10labor and workforce development, 1 of whom shall be an employee of the commonwealth in the
4040 11office of the secretary of labor and workforce development, 2 of whom shall be selected from a
4141 12list of 5 persons nominated by the Massachusetts Business Roundtable. 2 of 2
4242 13 The task force shall: (i) identify and review the state laws, regulations, and administrative
4343 14directives that are related to commission sales rates; (ii) identify the key labor sectors that would
4444 15best benefit from a review and improvement to sales commission rates; (iii) require the
4545 16department of labor and workforce development to create a report based on a customized survey
4646 17of companies within the commonwealth who employ commission-based employees; and (iv)
4747 18develop recommendations to establish legislative procedures to provide and regulate commission
4848 19rate income in Massachusetts.
4949 20 The task force shall submit a report, including any draft legislation and regulations, to the
5050 21clerks of the house of representatives and the senate within 12 months of the passage of this act.
