2727 An Act relative to worker compensation protections for certified medical cannabis patients and
2828 their caregivers.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 6 of Chapter 94I of the General Laws is hereby amended by
3232 2deleting after the existing text “This chapter shall not: (i)” the following text:- "require any
3333 3health insurance provider, or any government agency or authority, to reimburse any person for
3434 4the expenses of the medical use of marijuana; (ii)” and, by deleting “(iii)” and substituting
3535 5therefor “(ii)”
3636 6 SECTION 2. Section 30 of Chapter 152 of the General Laws is hereby amended by
3737 7inserting, after the text
3838 8 “Where services are provided to employees under this section, the reasonable and
3939 9necessary cost of such services shall be paid by the insurer.”, the following text: Such reasonable
4040 10and necessary service costs may include reimbursement for medical cannabis provided to injured
4141 11employees who are qualifying patients, or their personal caregiver, certified by a healthcare 2 of 2
4242 12professional pursuant to G.L. c. 94I as a qualifying patient, or serving as a qualifying patient's
4343 13personal caregiver under that chapter.
