2929 An Act relative to the school committee of the City of Revere.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Chapter 147 of said acts of 2004 is hereby amended by deleting the text of
3333 2section 4 and inserting in place thereof the following section:-
3434 3 SECTION 4. (a) Notwithstanding sections 31 or 36 of chapter 43 of the General
3535 4Laws or of any general or special law to the contrary, the school committee of the city of Revere
3636 5shall consist of the mayor and 8 members; 1 member of whom shall be elected by and from the
3737 6voters of each of the 6 respective wards into which the city is divided and 2 members of whom
3838 7shall be elected at large.
3939 8 (b)If a vacancy occurs in the office of school committee member, whether by death,
4040 9removal, resignation or otherwise, the candidate from that ward who received the second highest 2 of 2
4141 10number of votes at the last regular election or the at-large candidate who received the third
4242 11highest number of votes at the last regular election shall be sworn and take office immediately;
4343 12provided, however, such candidate is willing to serve, registered to vote and domiciled in the
4444 13appropriate ward, and otherwise eligible to fill the vacancy.
4545 14 (c)If there is no candidate meeting the requirements of subsection (b), or such
4646 15qualified candidate declines to be sworn to the position, the city council, and the remaining
4747 16members of the school committee, shall within 14 days following the date of the vacancy, meet
4848 17in joint convention and fill the vacancy by a majority vote of the city council and remaining
4949 18members of the school committee. The person selected to fill the vacancy under this section shall
5050 19be sworn and immediately take up the duties of the office. A vacancy occurring during the last 6
5151 20months of the term shall not be filled in the manner set forth herein.
5252 21 (d)Any person selected to fill a vacancy under subsections (b) and (c) shall be sworn
5353 22and take office immediately, serving until the the election results are certified and the elected
5454 23successor is qualified, at which time their successor shall be sworn and immediately take up the
5555 24duties of the office in addition to the full term to which they were elected. If the position remains
5656 25vacant, the candidate elected to the position at the next regular election shall be sworn and begin
5757 26serving on the on the day following the date on which the election results are certified and the
5858 27person elected to the vacancy is qualified, in addition to the full term to which they were elected.
5959 28 SECTION 2. This act shall take effect upon its passage.
