26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 Section 6 of Chapter 40A is hereby amended by striking the second paragraph and |
---|
29 | 29 | | 2replacing it with the following: |
---|
30 | 30 | | 3 A zoning ordinance or by-law shall provide that construction or operations under a |
---|
31 | 31 | | 4building permit shall conform to any subsequent amendment of the ordinance or by-law unless |
---|
32 | 32 | | 5the use or construction is commenced within a period of not more than twelve months after the |
---|
33 | 33 | | 6issuance of the permit and, in cases involving construction, unless such construction is continued |
---|
34 | 34 | | 7through to completion as continuously and expeditiously as is reasonable. Construction or |
---|
35 | 35 | | 8operations under a special permit or site plan approval shall conform to any subsequent |
---|
36 | 36 | | 9amendment of the zoning ordinance or by-law or of any other local land use regulations unless |
---|
37 | 37 | | 10the use or construction is commenced within a period of three years after the issuance of the |
---|
38 | 38 | | 11permit and, in cases involving construction, unless such construction is continued through to |
---|
39 | 39 | | 12completion as continuously and expeditiously as is reasonable. For the purpose of the prior |
---|
40 | 40 | | 13sentence, construction involving the redevelopment of previously disturbed land shall be deemed 2 of 2 |
---|
41 | 41 | | 14to have commenced upon substantial investment in site preparation and/or infrastructure |
---|
42 | 42 | | 15construction, and construction of developments intended to proceed in phases shall proceed |
---|
43 | 43 | | 16expeditiously, but not continuously, among phases. |
