3131 An Act establishing a special commission to study the use, disposal, and potential re-use of
3232 durable medical equipment in hospitals and care facilities under the jurisdiction of the
3333 Commonwealth.
3434 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3535 of the same, as follows:
3636 1 There is hereby established a special legislative commission to study the use, disposal
3737 2and potential re-use of durable medical equipment in hospitals and health care facilities under the
3838 3jurisdiction of the commonwealth.
3939 4 The commission shall consist of 13 members: 2 of whom shall be the house and senate
4040 5chairs of the joint committee on health care financing, who shall serve as co-chairs of the
4141 6commission; 2 of whom shall be the house and senate chairs of the joint committee on public
4242 7health; the secretary of elder affairs or a designee; the secretary of health and human services or
4343 8a designee; the director of MassHealth or a designee; and 6 members to be appointed by the 2 of 2
4444 9governor, 1 of whom shall be a member of the board of allied health professionals, 1 of whom
4545 10shall be a representative of the Massachusetts Nurses Association, 1 of whom shall be a
4646 11representative of the Massachusetts Medical Society, 1 of whom shall be a representative of the
4747 12Massachusetts Health and Hospital Association, Inc., 1 of whom shall be a representative of The
4848 13Massachusetts League of Community Health Centers, Inc., and 1 of whom shall be a
4949 14representative of the Conference of Boston Teaching Hospitals, Inc..
5050 15 All appointments shall be made no later than 14 days following the effective date of this
5151 16act. The co-chairs shall convene the first meeting of the special commission within 21 days of all
5252 17appointments being made.
5353 18 The special commission shall meet a minimum of 4 times. The special commission shall
5454 19submit its findings, along with recommendations for legislation, to the governor and the clerks of
5555 20the house of representatives and the senate no later than 180 days after the effective date of this
5656 21act.
