2626 An Act relative to hormonal contraceptives.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 94C, as appearing in the 2020 Official Edition, is hereby amended
3030 2by inserting, after section 19D, the following section:-
3131 3 Section 19E. A registered pharmacist may prescribe and dispense hormonal contraceptive
3232 4patches and self-administered oral hormonal contraceptives to any person, regardless of whether
3333 5the person has evidence of a previous prescription from a primary care practitioner or women’s
3434 6health care practitioner for a hormonal contraceptive patch or self-administered oral hormonal
3535 7contraceptive.
3636 8 The board shall adopt rules to establish, in consultation with the Massachusetts Medical
3737 9Board, the Massachusetts State Board of Nursing and MassHealth, and in consideration of
3838 10guidelines established by the American Congress of Obstetricians and Gynecologists, standard
3939 11procedures for the prescribing of hormonal contraceptive patches and self-administered oral 2 of 2
4040 12hormonal contraceptives by pharmacists. The rules adopted under this subsection must require a
4141 13pharmacist to:
4242 14 (a) Complete a training program approved by the State Board of Pharmacy that is related
4343 15to prescribing hormonal contraceptive patches and self-administered oral hormonal
4444 16contraceptives;
4545 17 (b) Provide a self-screening risk assessment tool that the patient must use prior to the
4646 18pharmacist’s prescribing the hormonal contraceptive patch or self-administered oral hormonal
4747 19contraceptive;
4848 20 (c) Refer the patient to the patient’s primary care practitioner or women’s health care
4949 21practitioner upon prescribing and dispensing the hormonal contraceptive patch or self-
5050 22administered oral hormonal contraceptive;
5151 23 (d) Provide the patient with a written record of the hormonal contraceptive patch or self-
5252 24administered oral hormonal contraceptive prescribed and dispensed and advise the patient to
5353 25consult with a primary care practitioner or women’s health care practitioner; and
5454 26 (e) Dispense the hormonal contraceptive patch or self-administered oral hormonal
5555 27contraceptive to the patient as soon as practicable after the pharmacist issues the prescription.
5656 28 The rules adopted must prohibit a pharmacist from requiring a patient to schedule an
5757 29appointment with the pharmacist for the prescribing or dispensing of a hormonal contraceptive
5858 30patch or self-administered oral hormonal contraceptive.
