2727 An Act allowing spouses to serve as caregivers.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Chapter 118E of the General Laws is hereby amended by inserting after
3131 2section 13L the following section:-
3232 3 Section 13M. To the extent permitted under federal law, spouses shall be authorized to
3333 4serve as paid caregivers in the MassHealth program for the provision of certain home-based care
3434 5and services.
3535 6 SECTION 2. The executive office of health and human services shall file a state plan
3636 7amendment or waiver application, as may be required, to implement this act no later than 6
3737 8months following the effective date of this act.
