27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |
---|
29 | 29 | | 1 SECTION 1. Section 265 of chapter 112 of the General Laws, as appearing in the 2020 |
---|
30 | 30 | | 2Official Edition, is hereby amended by striking out paragraphs (a) and (b) and inserting in place |
---|
31 | 31 | | 3thereof the following two sections: - |
---|
32 | 32 | | 4 (a) As used in this section, the following words shall have the following meanings unless |
---|
33 | 33 | | 5the context clearly requires otherwise: |
---|
34 | 34 | | 6 "Certified medical assistant", an individual who: (i) has graduated from a post-secondary |
---|
35 | 35 | | 7medical assisting education program accredited by the committee on allied health education and |
---|
36 | 36 | | 8accreditation of the American Medical Association or its successor, the Accrediting Bureau of |
---|
37 | 37 | | 9Health Education Schools or its successor or another certificate program that the commissioner |
---|
38 | 38 | | 10of public health may approve; (ii) is employed in a health care facility as defined in section 9C; |
---|
39 | 39 | | 11and (iii) performs basic administrative, clerical, and clinical duties upon the specific 2 of 2 |
---|
40 | 40 | | 12authorization and under the direct supervision of a practitioner as defined in section 1 of chapter |
---|
41 | 41 | | 1394C. |
---|
42 | 42 | | 14 "Direct supervision", oversight of a certified medical assistant exercised by a practitioner, |
---|
43 | 43 | | 15as defined in section 1 of chapter 94C, who is present in the facility and immediately available to |
---|
44 | 44 | | 16furnish assistance and direction throughout the course of the performance of a delegated |
---|
45 | 45 | | 17procedure; provided, however, that the practitioner shall not be required to be present in the |
---|
46 | 46 | | 18room when the procedure is performed. |
---|
47 | 47 | | 19 (b) Notwithstanding any general or special law to the contrary, a practitioner acting |
---|
48 | 48 | | 20within the practitioner’s designated scope of practice may delegate the administration of an |
---|
49 | 49 | | 21immunization of a patient to a certified medical assistant. |
