[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 3729 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to universal background checks for private gun sales. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Section 128A of chapter 140 of the General Laws, as so appearing, is hereby amended by 2adding the following:- Any sale or transfer conducted under this section shall comply with 3section 131E and shall take place at the location of a dealer licensed under section 122, who shall 4transmit the information required by this section for the purchases and sales by utilizing the 5Massachusetts Gun Transaction Portal established by the Massachusetts Department of Criminal 6Justice Information Services. A licensed dealer may charge the seller a fee not to exceed $25 for 7each sale or transfer electronically submitted on behalf of the seller to the Massachusetts Gun 8Transaction Portal. Whoever knowingly sells or transfers a firearm in violation of this section 9shall be punished by a fine of not less than $10,000 or by imprisonment for not more than 20 10years in state prison or two and one-half years in the house of correction.
