26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 G.L. Chapter 140, is amended by insertion of a new section: |
---|

30 | 30 | | 3 Notwithstanding any general or special law to the contrary, All applications for license or |
---|
31 | 31 | | 4card regarding the possession, transfer, carrying, or other lawful acts with a firearm, rifle or |
---|
32 | 32 | | 5shotgun shall be submitted to the Firearms Record Bureau. Said application can be submitted by |
---|
33 | 33 | | 6electronic, paper or other means as may be convenient to the applicant. |
---|
34 | 34 | | 7 Within seven days of the receipt of a completed application, the firearms record bureau |
---|
35 | 35 | | 8shall conduct a records search of any criminal record of the applicant arising from within or |
---|
36 | 36 | | 9without the commonwealth and determine whether the applicant is a prohibited person. Such |
---|
37 | 37 | | 10search shall include files maintained by the department of mental health, department of probation |
---|
38 | 38 | | 11and statewide and nationwide criminal justice, warrant and protection order information systems |
---|
39 | 39 | | 12and files including, but not limited to, the National Instant Criminal Background Check System. 2 of 2 |

40 | 40 | | 13If the information available to the firearms record bureau does not indicate that the applicant is a |
---|
41 | 41 | | 14prohibited person under state or federal law, the firearms record bureau shall issue such license |
---|
42 | 42 | | 15or card applied for within 30 days. |
---|
43 | 43 | | 16 The Secretary of Public Safety and Security shall be responsible for entire licensing |
---|
44 | 44 | | 17system as a whole and for the protection of the constitutional and other legal rights of any |
---|
45 | 45 | | 18applicant or license/card holder. |
