2929 An Act requiring human trafficking recognition training for certain hospitality workers.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 Chapter 140 of the General Laws, as appearing in the 2020 Official Edition, is hereby
3333 2amended by inserting after section 6B the following section:-
3434 3 Section 6C. (a) For the purposes of this section, “qualified accommodation” shall mean a
3535 4hotel, motel, lodging house or bed and breakfast establishment, as defined in section 1 of chapter
3636 564G, except for accommodations exempt from the room occupancy excise pursuant to section 2
3737 6of said chapter 64G.
3838 7 (b) Every licensed innholder operating a qualified accommodation shall establish a
3939 8human trafficking recognition training program, and shall require every employee of such
4040 9accommodation to participate in the training program. The training program shall be approved by 2 of 3
4141 10the attorney general, and may be provided by organizations or providers approved by the
4242 11attorney general pursuant to subsection (d). The training program may be developed by a federal,
4343 12state or nonprofit organization, and may be incorporated as part of the innholder’s existing
4444 13training programs. Human trafficking recognition training programs required pursuant to this
4545 14section shall include, but shall not be limited to training relative to:
4646 15 (i) the nature of human trafficking;
4747 16 (ii) how human trafficking is defined pursuant to section 50 and 51 of chapter 265;
4848 17 (iii) how to identify victims of human trafficking, as defined in section 20M of chapter
4949 18233;
5050 19 (iv) relief and recovery options for survivors; and
5151 20 (v) social and legal services available to victims.
5252 21 (c) Every licensed innholder operating a qualified accommodation shall post in plain
5353 22view, in the lobby and in any public restroom of such qualified accommodation, a written notice
5454 23developed by the attorney general, which shall include the national human trafficking hotline
5555 24telephone number and the number for the human trafficking hotline established by the attorney
5656 25general pursuant to subsection (d).
5757 26 (d) The attorney general shall: (i) make available a list of approved human trafficking
5858 27recognition training programs for use by a licensed innholder operating a qualified
5959 28accommodation pursuant to this section; (ii) develop a standard written notice to be posted in
6060 29every qualified accommodation pursuant to subsection (c); and (iii) establish a toll-free hotline
6161 30for reporting human trafficking. 3 of 3
6262 31 (e) The attorney general shall promulgate regulations necessary to implement this section.
