| 29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 30 | 30 | | of the same, as follows: |

| 31 | 31 | | 1 SECTION 1. Chapter 32 of the General Laws is hereby amended by adding the following |
|---|
| 32 | 32 | | 2section:- |
|---|
| 33 | 33 | | 3 94C. Notwithstanding the provisions of any general or special law to the contrary |
|---|
| 34 | 34 | | 4affecting the non-contributory or contributory system, any condition of impairment of health |
|---|
| 35 | 35 | | 5caused by an infectious disease resulting in total or partial disability or death to an employee of a |
|---|
| 36 | 36 | | 6correctional facility, shall, if he successfully passed a physical examination on entry into such |
|---|
| 37 | 37 | | 7service, or subsequently successfully passed a physical examination, which examination failed to |
|---|
| 38 | 38 | | 8reveal any evidence of such condition, be presumed to have been suffered in the line of duty, |
|---|
| 39 | 39 | | 9unless the contrary be shown by competent evidence. |
