30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION 1. Notwithstanding section 7 of chapter 32 of the General Laws or any other |
---|
33 | 33 | | 2general or special law to the contrary, and in order to promote the public good, the State Board of |
---|
34 | 34 | | 3Retirement shall grant an increased accidental disability retirement allowance to Lieutenant |
---|
35 | 35 | | 4Howard S. Levine of the Town of Raynham, who as a result of injuries sustained while in the |
---|
36 | 36 | | 5performance of his duties on September 3, 1990 is permanently unable to perform the essential |
---|
37 | 37 | | 6duties of his job and incapacitated for further services as a Correction Office III. Howard S. |
---|
38 | 38 | | 7Levine shall receive a yearly amount of pension of 72% of the rate of compensation which would |
---|
39 | 39 | | 8have been paid to him had he continued in service as a Correction Officer III of the Department |
---|
40 | 40 | | 9of Correction which was held by him at the time of his retirement. This disability allowance shall |
---|
41 | 41 | | 10maintain parity with Correction Officer III collective bargaining increases of pay. 2 of 2 |

42 | 42 | | 11 SECTION 2. Upon the death of Howard S. Levine, leaving Charlene Ann Levine, his |
---|
43 | 43 | | 12wife, surviving him, the State Board of Retirement shall pay to her so long as she remains |
---|
44 | 44 | | 13unmarried, an annuity of the amount of three-fourths of the amount of the pension payable to |
---|
45 | 45 | | 14him at the time of his death. |
---|
46 | 46 | | 15 SECTION 3. This act shall take effect upon its passage. |
