2929 An Act relative to the retirement benefits of Howard S. Levine.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Notwithstanding section 7 of chapter 32 of the General Laws or any other
3333 2general or special law to the contrary, and in order to promote the public good, the State Board of
3434 3Retirement shall grant an increased accidental disability retirement allowance to Lieutenant
3535 4Howard S. Levine of the Town of Raynham, who as a result of injuries sustained while in the
3636 5performance of his duties on September 3, 1990 is permanently unable to perform the essential
3737 6duties of his job and incapacitated for further services as a Correction Office III. Howard S.
3838 7Levine shall receive a yearly amount of pension of 72% of the rate of compensation which would
3939 8have been paid to him had he continued in service as a Correction Officer III of the Department
4040 9of Correction which was held by him at the time of his retirement. This disability allowance shall
4141 10maintain parity with Correction Officer III collective bargaining increases of pay. 2 of 2
4242 11 SECTION 2. Upon the death of Howard S. Levine, leaving Charlene Ann Levine, his
4343 12wife, surviving him, the State Board of Retirement shall pay to her so long as she remains
4444 13unmarried, an annuity of the amount of three-fourths of the amount of the pension payable to
4545 14him at the time of his death.
4646 15 SECTION 3. This act shall take effect upon its passage.
