2626 An Act relative to motor vehicle mechanics.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 13 of the General Laws is hereby amended by adding the following section:-
3030 2 Section 110. (a) There shall be within the division of professional licensure a board of
3131 3examiners of motor vehicle mechanics to consist of the commissioner of public safety or his
3232 4designee, the director of professional licensure or his designee and 5 persons, residents of the
3333 5commonwealth, to be appointed by the governor for terms of 3 years, 4 of whom shall be motor
3434 6vehicle mechanics with at least 10 years of practical experience and who are wage earners, and 1
3535 7of whom shall be a representative of the public and subject to section 9B.
3636 8 (b) No member shall serve for more than 2 consecutive and complete 3-year terms. As
3737 9the term of the office of a member expires, a successor shall be appointed in like manner for a
3838 10term of 3 years. The governor may fill a vacancy in the board for the unexpired portion of the
3939 11term. 2 of 2
4040 12 (c) The board shall annually elect from among its members a chairman and vice-
4141 13chairman. The board shall meet at least 4 times annually and may hold additional meetings as
4242 14necessary to discharge its duties. Members shall serve without compensation but shall be entitled
4343 15to reasonable travel expenses. The members of the board shall be public employees for the
4444 16purposes of chapter 258 for all acts or omissions within the scope of their duties as board
4545 17members.
4646 18 (d) The board shall have the following powers and duties: (i) establish such qualifications
4747 19for the licensing of motor vehicle mechanics as may be necessary for the welfare of the public
4848 20and the motor vehicle repair industry; provided that no individual shall be licensed as a motor
4949 21vehicle mechanic without first receiving certification as provided for by the board; (ii) to adopt
5050 22rules and regulations governing the licensure of motor vehicle mechanics, and business entities
5151 23and schools teaching auto mechanic work; (iii) to establish standards of professional and ethical
5252 24conduct; (iv) to establish standards for continuing education reflecting acceptable national
5353 25standards; and (v) in conjunction with the division of professional licensure, to investigate
5454 26complaints, conduct inspections, request and review business records of licensees, and set and
5555 27administer penalties as defined in sections 61 to 65E, inclusive, of said chapter 112.
