| 29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 30 | 30 | | of the same, as follows: |
|---|
| 31 | 31 | | 1 Section 1. Section 2 of chapter 32A of the General Laws, as appearing in the 2012 |
|---|
| 32 | 32 | | 2Official Edition, is hereby amendment by inserting after the word "withheld", in line 126, the |
|---|
| 33 | 33 | | 3following words:-; provided, however, that the term "elderly governmental retiree" shall include |
|---|
| 34 | 34 | | 4any retired employee age 70 or over who has been retired for 5 years. |
|---|
| 35 | 35 | | 5 Section 2. Said chapter 32A, as so appearing, is hereby further amended by inserting after |
|---|
| 36 | 36 | | 6section 10B the following section:- |
|---|
| 37 | 37 | | 7 Section 10C. For any elderly governmental retiree of any municipality that provides |
|---|
| 38 | 38 | | 8prescription drug benefits, such retiree shall be entitled to reimbursement from the State Retirees |
|---|
| 39 | 39 | | 9Benefits Trust Fund to be used exclusively to reduce the cost of prescription drugs for such 2 of 2 |
|---|
| 40 | 40 | | 10retiree. The reduction of the cost of such prescription drugs shall be no less than 25 per cent of |
|---|
| 41 | 41 | | 11any co-payment amount paid by an elderly governmental retiree for such prescription drugs. The |
|---|
| 42 | 42 | | 12trustee of the fund shall establish the reimbursement methodology for such payment in |
|---|
| 43 | 43 | | 13conjunction with any participating municipality. |
|---|
| 44 | 44 | | 14 Section 3. Section 24 of said chapter 32A, as so appearing, is hereby amended by |
|---|
| 45 | 45 | | 15inserting after the word "board", in line 29, the following words:-; provided that, a municipality |
|---|
| 46 | 46 | | 16providing prescription drug coverage to an elderly governmental retiree shall participate in the |
|---|
| 47 | 47 | | 17fund using the procedures set forth in section 10C |
|---|
