2828 An Act relative to employee protections.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 I. Protection from Forced Vaccination. -
3232 2 Every person has the natural, essential, and inherent right to bodily integrity, free from
3333 3any threat or compulsion by government to accept an immunization. Accordingly, no person
3434 4may be compelled to receive an immunization for COVID-19 in order to secure, receive, or
3535 5access any public facility, any public benefit, or any public service from the Commonwealth of
3636 6Massachusetts, or any political subdivision thereof, including but not limited to counties, cities,
3737 7towns, precincts, water districts, school districts, school administrative units, or quasi-public
3838 8entities. 2 of 2
3939 9 No person may be terminated from a position of employment at the Commonwealth of
4040 10Massachusetts or any political subdivision thereof, including but not limited to counties, cities,
4141 11towns, precincts, water districts, school districts, school administrative units, or quasi-public
4242 12entities due to not receiving the COVID-19 Vaccination.
4343 13 II. Prohibition Against Public Agencies Issuing or Establishing COVID-19 Vaccine
4444 14Passports. –
4545 15 Notwithstanding any other provision of State or federal law, State or federal rule,
4646 16executive order, local ordinance, or State or local declaration of emergency, no officer or
4747 17employee of the State or any political subdivision of the State may issue or establish any
4848 18standardized documentation, including something styled as a vaccine passport or vaccine pass,
4949 19for the purpose of verifying an individual's COVID-19 vaccination status to a third party, or
5050 20otherwise publish or share any individual's COVID-19 vaccination record.
5151 21 Nothing in this section shall prohibit an individual who has received a COVID-19
5252 22vaccination from receiving from the person who administered the vaccine a COVID-19
5353 23Vaccination Record Card from the Centers for Disease Control and Prevention indicating the
5454 24person received a COVID-19 vaccination.
5555 25 III. This act shall take effect upon its passage.
