33 | 33 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
34 | 34 | | of the same, as follows: |
---|
35 | 35 | | 1 SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
36 | 36 | | 2licensing authority of the town of Raynham may grant two additional licenses for the sale of all |
---|
37 | 37 | | 3alcoholic beverages not to be drunk on the premises under the provisions of section 15 of said |
---|
38 | 38 | | 4chapter 138 to establishments located within the two development zones as those areas are |
---|
39 | 39 | | 5defined in subsection (b). A license granted under this section shall be clearly marked on its face |
---|
40 | 40 | | 6“748 New State Highway Restricted” or “Broadway Restricted” and shall be subject to all of said |
---|
41 | 41 | | 7chapter 138 except said section 17. 2 of 3 |
---|
42 | 42 | | 8 (b) The licensing authority shall restrict the 2 licenses as follows: (i) one license shall be |
---|
43 | 43 | | 9issued to an establishment located at 748 New State Highway, US-44; and (ii) one license shall |
---|
44 | 44 | | 10be issued to an establishment located on Broadway, MA-138, between its intersection with |
---|
45 | 45 | | 11Interstate-495 and Center Street. |
---|
46 | 46 | | 12 (c) The licensing authority shall not approve the transfer of a license granted under this |
---|
47 | 47 | | 13act to a location outside of the area for which the license was initially granted, but it may grant a |
---|
48 | 48 | | 14license to a new applicant within the area for which the license was initially granted if the |
---|
49 | 49 | | 15applicant files with the licensing authority a letter from the department of revenue and a letter |
---|
50 | 50 | | 16from the department of unemployment assistance indicating that the license is in good standing |
---|
51 | 51 | | 17with those departments and that all applicable taxes, fees and contributions have been paid. |
---|
52 | 52 | | 18 (d) A license granted under this act shall not be sold or transferred by the licensee. |
---|
53 | 53 | | 19 (e) If a licensee terminates or fails to renew a license granted under clause (i) of |
---|
54 | 54 | | 20subsection (b) or the license granted under said clause is cancelled, revoked or no longer in use it |
---|
55 | 55 | | 21shall be returned physically, with all the of the legal rights, privileges and restrictions pertaining |
---|
56 | 56 | | 22thereto, to the licensing authority, and the licensing authority may, within 3 years after such |
---|
57 | 57 | | 23return, then grant the license to a new applicant under the same conditions as specified in this |
---|
58 | 58 | | 24section, otherwise such license shall dissolve. |
---|
59 | 59 | | 25 (f) If a licensee terminates or fails to renew a license granted under clause (ii) of |
---|
60 | 60 | | 26subsection (b) or the license granted under said clause is cancelled, revoked or no longer in use it |
---|
61 | 61 | | 27shall be returned physically, with all the of the legal rights, privileges and restrictions pertaining |
---|
62 | 62 | | 28thereto, to the licensing authority, and the licensing authority may then grant the license to a new |
---|
63 | 63 | | 29applicant under the same conditions as specified in this section. 3 of 3 |
---|
64 | 64 | | 30 (e) A license granted pursuant to this section shall be issued within 1 year after the |
---|
65 | 65 | | 31effective date of this act; provided, however, that if the license is originally granted within that |
---|
66 | 66 | | 32time period, the license may be granted to a new applicant pursuant to subsections (c) through (f) |
---|
67 | 67 | | 33thereafter. |
---|
68 | 68 | | 34 SECTION 2. This act shall take effect upon its passage. |
---|
