28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |

30 | 30 | | 1 SECTION 1. Notwithstanding the provisions of any general or special law to the |
---|
31 | 31 | | 2contrary, the excise on alcohol as described in section 21 of chapter 138 of the General Laws is |
---|
32 | 32 | | 3hereby amended by striking out, in subsection (a) , the words “three dollars and thirty cents” and |
---|
33 | 33 | | 4inserting in place thereof the following words:- “six dollars and sixty cents”. |

34 | 34 | | 5 SECTION 2. Said Section 21 is hereby further amended by striking out, in subsection |
---|
35 | 35 | | 6(b), the word “three cents” and inserting in place thereof the following word:— “six cents”. |

53 | 53 | | 24 SECTION 35YY. There shall be established and set up on the books of the |
---|
54 | 54 | | 25commonwealth a separate fund to be known as the substance abuse health protection fund. |
---|
55 | 55 | | 26There shall be credited to said fund all amounts collected under Section 21, subsections (a) to |
---|
56 | 56 | | 27(g), of Chapter 138 from the sale of alcoholic beverages that are not considered to be sales of |
---|
57 | 57 | | 28meals, together with any penalties, forfeitures, interest, costs of suits and fines collected in |
---|
58 | 58 | | 29connection therewith, less all amounts refunded or abated in connection therewith, all as |
---|
59 | 59 | | 30determined by the commissioner of revenue according to his best information and belief; any |
---|
60 | 60 | | 31appropriation, grant, gift, or other contribution explicitly made to aid fund; and any income 3 of 3 |
---|
61 | 61 | | 32derived from the investment of amounts credited to said fund; 100 percent of the amounts |
---|
62 | 62 | | 33credited to such fund shall be expended without further appropriation, by the department of |
---|
63 | 63 | | 34public health to provide funding, or supplement existing levels of funding, for the following |
---|
64 | 64 | | 35purposes:- |
---|
65 | 65 | | 36 (a) For a comprehensive substance abuse treatment program, to be administered by the |
---|
66 | 66 | | 37department of public health, for the treatment of individuals who are dependent on or addicted to |
---|
67 | 67 | | 38alcohol or controlled substances, and who lack public or private health insurance that would |
---|
68 | 68 | | 39provide coverage for such treatment. |
---|
69 | 69 | | 40 (b) Subject to the approval of the department of public health, for comprehensive |
---|
70 | 70 | | 41school health education programs to be administered by the department of education; provided |
---|
71 | 71 | | 42that such programs shall incorporate information relating to the hazards of alcohol and controlled |
---|
72 | 72 | | 43substance use; and |
---|
73 | 73 | | 44 (c) Subject to the approval of the department of public health, for substance abuse |
---|
74 | 74 | | 45treatment programs administered by the office of community corrections, the department of |
---|
75 | 75 | | 46corrections, the department of children and families, the department of youth services, and the |
---|
76 | 76 | | 47office of the commissioner of probation; |
---|
77 | 77 | | 48 (d) For community and workplace-based and community substance abuse prevention |
---|
78 | 78 | | 49and drinking cessation programs, for substance abuse-related public service advertising and for |
---|
79 | 79 | | 50drug and alcohol education program, to be administered by the department of public health. |
---|
80 | 80 | | 51 The commissioner of public health shall annually file a report with the house and senate |
---|
81 | 81 | | 52committees on ways and means and the joint committee on public health detailing the activity of |
---|
82 | 82 | | 53the fund. |
