29	29	An Act ensuring consistent reimbursement of PILOT funding.
30	30	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
31	31	of the same, as follows:
32	32	1 SECTION 1. Section 16 of chapter 58 of the General Laws, as appearing in the 2014
33	33	2Official Edition, is hereby amended by inserting after the word "section", in line 5, the following
34	34	3words:-; provided, however, that if the measurable acreage of land pursuant to section 13 in the
35	35	4city or town has remained the same or increased from the previous fiscal year, the total amount
36	36	5reimbursed to a city or town by the commonwealth pursuant to section 17 shall not be less than
37	37	6the amount that was reimbursed to the city or town in the previous fiscal year.
38	38	7 SECTION 2. Section 17 of chapter 58 of the General Laws, as appearing in the 2014
39	39	8Official Edition, is hereby amended by inserting after the word "sixty-three", in line 7, the
40	40	9following words:- ; provided, however, that if the measurable acreage of land pursuant to section 2 of 2
41	41	1013 in the city or town has remained the same or increased from the previous fiscal year, the total
42	42	11amount reimbursed to a city or town by the commonwealth shall not be less than the amount that
43	43	12was reimbursed to the city or town in the previous fiscal year.
44	44	13 SECTION 3. Section 108 of chapter 218 of the acts of 2016 is hereby amended by
45	45	14striking out section 16 and inserting in place thereof the following section:-
46	46	15 Section 16. The commissioner shall annually deliver, to the state treasurer, a statement of
47	47	16the fair cash valuation reimbursement percentage for each city and town in which state-owned
48	48	17land is located, and of the amount of money to be paid to each such city and town as determined
49	49	18by the following section; provided, however, that if the measurable acreage of state-owned land
50	50	19in the city or town has remained the same or increased from the previous fiscal year, the total
51	51	20amount reimbursed to a city or town by the commonwealth pursuant to said section shall not be
52	52	21less than the amount that was reimbursed to the city or town in the previous fiscal year.
53	53	22 SECTION 4. Said section 108 of said chapter 218 of the acts of 2016, is hereby further
54	54	23amended by striking out, in section 17, the first sentence and inserting in place thereof the
55	55	24following sentence:- The treasurer shall annually reimburse each city and town in which state-
56	56	25owned land is located, an amount in lieu of taxes upon the reimbursement percentages reported
57	57	26to the treasurer by the commissioner under the preceding section, determined by multiplying the
58	58	27percentages by the amount appropriated for such purposes for the fiscal year; provided, however,
59	59	28that if the measurable acreage of state-owned land in the city or town has remained the same or
60	60	29increased from the previous fiscal year, the total amount reimbursed to a city or town by the
61	61	30commonwealth shall not be less than the amount that was reimbursed to the city or town in the
62	62	31previous fiscal year.
