2727 An Act to protect the intent of the Fair Share Amendment.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Section 5G of Chapter 29 of the General Laws, as appearing in the 2020
3131 2Official Edition, is hereby further amended by inserting, at the end of its first paragraph, the
3232 3following: -- For purposes of this section, tax revenues estimated to have been collected from
3333 4capital gains income shall not include any revenues attributable to the Amendment to the
3434 5Constitution adopted by the voters at the 2022 general election.
3535 6 SECTION 2. Section 2 of Chapter 62F of the General Laws, as so appearing, is hereby
3636 7amended by inserting the following language, immediately before the period at the end of the
3737 8definition of “State Tax Revenues”: -- and the additional revenues attributable to the Amendment
3838 9to the Constitution adopted by the voters at the 2022 general election”
3939 10 SECTION 3. Section 6 of said Chapter 62F, as so appearing, is hereby amended by
4040 11inserting at the end of the first paragraph the following: -- For purposes of this section, a 2 of 2
4141 12taxpayer’s personal income tax liability shall not include any liability imposed pursuant to the
4242 13Amendment to the Constitution adopted by the voters at the 2022 general election.
