| 38 | 38 | | 5municipalities, as defined in section 3A of chapter 23A; and municipalities experiencing a |

| 39 | 39 | | 6difficulty to pay for capital improvements to their public safety and security facilities; provided |

| 40 | 40 | | 7further, public safety and security facilities shall also include municipally owned facilities and |

| 41 | 41 | | 8state owned facilities, as provided in chapter 61 of the acts of 2009. |
