26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |

28 | 28 | | 1 Section 11F of Chapter 25A of the General Laws, as appearing in the 2018 Official |

29 | 29 | | 2Edition, is hereby amended by adding at the end of subsection (e) the following:- |
---|
30 | 30 | | 3 Provided however, every energy retail supplier shall provide Massachusetts end-use |
---|
31 | 31 | | 4customers a minimum requirement of 3.8 per cent of kilowatt-hour sales of energy attributes |
---|
32 | 32 | | 5from Class II non-waste-to-energy generation, as described in subsection (d), for supply |
---|
33 | 33 | | 6contracts starting, or renewed, on and after January 1, 2023. Beginning in 2023, the department |
---|
34 | 34 | | 7shall annually conduct an analysis and reset the energy retail supplier’s minimum requirement of |
---|
35 | 35 | | 8Class II non-waste-to-energy generation attributes for new or renewed retail supplier contracts in |
---|
36 | 36 | | 9the calendar year following each annual review, to ensure and promote the continued operation |
---|
37 | 37 | | 10of existing energy generating resources that meet the requirements of said subsection (d), but at |
---|
38 | 38 | | 11no time shall the minimum percentage requirement for energy retail suppliers be set lower than |
---|
39 | 39 | | 123.8 per cent. |
