2828 An Act relative to airplane noise data collection and Good Neighbor Policy.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 Chapter 90 Section 60 of Part I, Title II, Chapter 6C as appearing in the General Laws is
3232 2hereby amended by adding the following new section:
3333 3 Paragraph 1. The Massachusetts Aeronautics Division (“The Division”) shall collect and
3434 4post annually on its website all noise reports and complaints made to each Municipal or Regional
3535 5Airport between April 1 and October 1.
3636 6 For the purposes of this section, “noise complaint” shall refer to any complaint or report
3737 7of excessive noise and shall include the day, date and hour of the week it occurred made via
3838 8airport website, App, telephone, voicemail, email, written letter or in-person visit to the Airport
3939 9or to a Commissioner by any resident. 2 of 3
4040 10 This data shall be collected by The Division no later than 14 days following the end of
4141 11each month and posted in a readily accessible section of the Division’s public website no later
4242 12than 20 days following the end each month. The data shall be posted with labeling for each
4343 13airport and shall remain on the website in perpetuity.
4444 14 Paragraph 2. The Division shall collect from each Tower the number and time of day of
4545 15all so-called Touch and Go operations between April 1 and October 1. This data shall be
4646 16collected no later than 14 days following the end of each month and posted with labeling for
4747 17each Municipal or Regional Airport and shall be posted in a readily accessible section of each
4848 18Airport’s public website no later than 20 days following the end each month and shall remain on
4949 19the website in perpetuity.
5050 20 The Administrator of The Division shall share all noise data collected with the House and
5151 21Senate Chairs of the Joint Committee on Transportation and with the Secretary of Transportation
5252 22by December 31 of each year.
5353 23 Paragraph 3. At the request of at least two commissioners of any Municipal or Regional
5454 24Airport, an Airport Commission shall convene a public meeting devoted to noise reports at
5555 25which members of the public may ask questions of Commission Members and the Airport
5656 26Manager, who shall, to the best of their ability, answer the questions.
5757 27 Paragraph 4. It shall be the responsibility of The Division to provide annually to all
5858 28regional Municipal and Airport Managers and Commissioners guidance in the development,
5959 29implementation and oversight of a policy, commonly referred to as Good Neighbor or Fly
6060 30Neighborly policy, designed to facilitate an understanding among flight school owners, flight
6161 31school instructors and student pilots and all pilots of the airport of the noise impact of Touch and 3 of 3
6262 32Go operations on neighbors within three miles of runways. Said Good Neighbor policy guidance
6363 33shall include but not be limited to providing airports with a sample written policy, providing a
6464 34written copy of the policy to be given to all student pilots and pilots to be posted visibly in
6565 35several locations, including pilot areas, suggested steps for informing all airport tenants of the
6666 36policy, and providing a social media toolkit for publicizing said policy to all airport tenants,
6767 37pilots, student pilots and Commissioners.
6868 38 Paragraph 5. Each applicant for a badge at any Municipal Airport shall submit with
6969 39their application a written attestation that they have read the Good Neighbor Policy for that
7070 40Airport and will abide by said policy.
7171 41 This act shall take effect on January 1, 2024.
