29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |

31 | 31 | | 1 Chapter 90 Section 60 of Part I, Title II, Chapter 6C as appearing in the General Laws is |
---|
32 | 32 | | 2hereby amended by adding the following new section: |
---|
33 | 33 | | 3 Paragraph 1. The Massachusetts Aeronautics Division (“The Division”) shall collect and |
---|
34 | 34 | | 4post annually on its website all noise reports and complaints made to each Municipal or Regional |
---|
35 | 35 | | 5Airport between April 1 and October 1. |
---|
36 | 36 | | 6 For the purposes of this section, “noise complaint” shall refer to any complaint or report |
---|
37 | 37 | | 7of excessive noise and shall include the day, date and hour of the week it occurred made via |
---|
38 | 38 | | 8airport website, App, telephone, voicemail, email, written letter or in-person visit to the Airport |
---|
39 | 39 | | 9or to a Commissioner by any resident. 2 of 3 |

40 | 40 | | 10 This data shall be collected by The Division no later than 14 days following the end of |
---|
41 | 41 | | 11each month and posted in a readily accessible section of the Division’s public website no later |
---|
42 | 42 | | 12than 20 days following the end each month. The data shall be posted with labeling for each |
---|
43 | 43 | | 13airport and shall remain on the website in perpetuity. |
---|
44 | 44 | | 14 Paragraph 2. The Division shall collect from each Tower the number and time of day of |
---|
45 | 45 | | 15all so-called Touch and Go operations between April 1 and October 1. This data shall be |
---|
46 | 46 | | 16collected no later than 14 days following the end of each month and posted with labeling for |
---|
47 | 47 | | 17each Municipal or Regional Airport and shall be posted in a readily accessible section of each |
---|
48 | 48 | | 18Airport’s public website no later than 20 days following the end each month and shall remain on |

49 | 49 | | 19the website in perpetuity. |

50 | 50 | | 20 The Administrator of The Division shall share all noise data collected with the House and |
---|
51 | 51 | | 21Senate Chairs of the Joint Committee on Transportation and with the Secretary of Transportation |

52 | 52 | | 22by December 31 of each year. |

53 | 53 | | 23 Paragraph 3. At the request of at least two commissioners of any Municipal or Regional |
---|
54 | 54 | | 24Airport, an Airport Commission shall convene a public meeting devoted to noise reports at |
---|
55 | 55 | | 25which members of the public may ask questions of Commission Members and the Airport |
---|
56 | 56 | | 26Manager, who shall, to the best of their ability, answer the questions. |
---|
57 | 57 | | 27 Paragraph 4. It shall be the responsibility of The Division to provide annually to all |
---|
58 | 58 | | 28regional Municipal and Airport Managers and Commissioners guidance in the development, |
---|
59 | 59 | | 29implementation and oversight of a policy, commonly referred to as Good Neighbor or Fly |
---|
60 | 60 | | 30Neighborly policy, designed to facilitate an understanding among flight school owners, flight |
---|
61 | 61 | | 31school instructors and student pilots and all pilots of the airport of the noise impact of Touch and 3 of 3 |
---|
62 | 62 | | 32Go operations on neighbors within three miles of runways. Said Good Neighbor policy guidance |
---|
63 | 63 | | 33shall include but not be limited to providing airports with a sample written policy, providing a |
---|
64 | 64 | | 34written copy of the policy to be given to all student pilots and pilots to be posted visibly in |
---|
65 | 65 | | 35several locations, including pilot areas, suggested steps for informing all airport tenants of the |
---|
66 | 66 | | 36policy, and providing a social media toolkit for publicizing said policy to all airport tenants, |
---|
67 | 67 | | 37pilots, student pilots and Commissioners. |
---|
68 | 68 | | 38 Paragraph 5. Each applicant for a badge at any Municipal Airport shall submit with |
---|
69 | 69 | | 39their application a written attestation that they have read the Good Neighbor Policy for that |
---|
70 | 70 | | 40Airport and will abide by said policy. |
---|
71 | 71 | | 41 This act shall take effect on January 1, 2024. |
