[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 3521 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to gender identity on Massachusetts identification. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 SECTION 1. Chapter 90 of the General Laws is hereby amended by inserting after 2section 8M the following section:- 3 Section 8N. The registry of motor vehicles shall permit a person submitting an 4application under sections 8, 8B, or 8E of this chapter or section 34B of chapter 138 to designate 5“X” for gender in lieu of “male” or “female” on an application for a driver’s license, learner’s 6permit, identification card or liquor purchase identification card. No documentation shall be 7required for such designations. 8 SECTION 2. Notwithstanding any other general or specific law to the contrary, the 9registry of motor vehicles shall, not later than November 1, 2025, permit a person submitting an 2 of 2 10application under sections 8, 8B, or 8E of chapter 90 or section 34B of chapter 138 to designate 11“X” for gender in lieu of “male” or “female” on an application for a driver’s license, learner’s 12permit, identification card or liquor purchase identification card. No documentation shall be 13required for such designations. 14 SECTION 3. The registrar of motor vehicles may promulgate regulations to implement 15this act. The regulations may be amended, as appropriate, to allow for a person submitting an 16application under sections 8, 8B or 8E of chapter 90 or section 34B of chapter 138 to designate 17“X” and additional designations for gender in lieu of “X”, “male” or “female” if such additional 18designation appropriately reflects the gender identity of applications. 19 SECTION 4. Section 1 shall take effect on November 1, 2025.
