2626 An Act relative to translated CNA exams.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 111 of the General Laws is hereby amended by striking out section
3030 272W and inserting in place thereof the following section:-
3131 3 (a) As used in this section the following words shall have the following meanings:-
3232 4 “Long term care facility”, a convalescent home, nursing home, rest home or charitable
3333 5home for the aged licensed under the provisions of section seventy-one.
3434 6 “Nurses’ aide”, any employee of a long term care facility who provides nursing care
3535 7under the supervision of a nurse for the purpose of providing safety, comfort, personal hygiene
3636 8or protection of a patient in a long term care facility.
3737 9 (b) The commissioner after consultation with the secretary of elder affairs and the board
3838 10of registration shall establish standards for the training of nurses’ aides which shall include a
3939 11minimum of sixty hours of training. 2 of 2
4040 12 (c) Any person administering a long term care facility who hires a nurses’ aide shall
4141 13provide such training for said nurses’ aide within ninety days of the commencement of
4242 14employment.
4343 15 (d) Any long term care facility which complies with the provisions of this section shall
4444 16have the costs of such compliance recognized in its interim rate of payment.
4545 17 (e) A nurses’ aide who receives their training and works in a facility whose resident
4646 18population is predominantly non-English speaking, shall be offered the option to take the nurses’
4747 19aide certification exam in a language other than English, including, but not limited to, Spanish
4848 20and Chinese; provided, however, that the department shall determine which languages the exam
4949 21shall be offered in.
5050 22 (f) The department shall make such rules and regulations as may be necessary to carry
5151 23out the provisions of this section.
5252 24 SECTION 2. Section 1 shall take effect on October 1, 2024.
