| 27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 28 | 28 | | of the same, as follows: |

| 29 | 29 | | 1 SECTION 1. Chapter 111 of the General Laws is hereby amended by striking out section |
|---|
| 30 | 30 | | 272W and inserting in place thereof the following section:- |
|---|
| 31 | 31 | | 3 (a) As used in this section the following words shall have the following meanings:- |
|---|
| 32 | 32 | | 4 “Long term care facility”, a convalescent home, nursing home, rest home or charitable |
|---|
| 33 | 33 | | 5home for the aged licensed under the provisions of section seventy-one. |
|---|
| 34 | 34 | | 6 “Nurses’ aide”, any employee of a long term care facility who provides nursing care |
|---|
| 35 | 35 | | 7under the supervision of a nurse for the purpose of providing safety, comfort, personal hygiene |
|---|
| 36 | 36 | | 8or protection of a patient in a long term care facility. |
|---|
| 37 | 37 | | 9 (b) The commissioner after consultation with the secretary of elder affairs and the board |
|---|
| 38 | 38 | | 10of registration shall establish standards for the training of nurses’ aides which shall include a |
|---|
| 39 | 39 | | 11minimum of sixty hours of training. 2 of 2 |

| 40 | 40 | | 12 (c) Any person administering a long term care facility who hires a nurses’ aide shall |
|---|
| 41 | 41 | | 13provide such training for said nurses’ aide within ninety days of the commencement of |
|---|
| 42 | 42 | | 14employment. |
|---|
| 43 | 43 | | 15 (d) Any long term care facility which complies with the provisions of this section shall |
|---|
| 44 | 44 | | 16have the costs of such compliance recognized in its interim rate of payment. |
|---|
| 45 | 45 | | 17 (e) A nurses’ aide who receives their training and works in a facility whose resident |
|---|
| 46 | 46 | | 18population is predominantly non-English speaking, shall be offered the option to take the nurses’ |
|---|
| 47 | 47 | | 19aide certification exam in a language other than English, including, but not limited to, Spanish |
|---|
| 48 | 48 | | 20and Chinese; provided, however, that the department shall determine which languages the exam |
|---|
| 49 | 49 | | 21shall be offered in. |
|---|
| 50 | 50 | | 22 (f) The department shall make such rules and regulations as may be necessary to carry |
|---|
| 51 | 51 | | 23out the provisions of this section. |
|---|
| 52 | 52 | | 24 SECTION 2. Section 1 shall take effect on October 1, 2024. |
