2929 An Act concerning horse racing within the town of Plymouth.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION I. The purpose of this legislation is to ensure that the citizens of Plymouth
3333 2have the opportunity to decide whether horse racing shall be licensed in their town.
3434 3 SECTION 2. For the purpose of this act, "horse racing" shall mean every meeting where
3535 4horses are raced and where any form of betting or wagering on the speed or ability of horses is
3636 5permitted.
3737 6 SECTION 3. (a) Except as provided in this section there shall be no horse racing in the
3838 7town of Plymouth. 2 of 2
3939 8 (b) Upon application to the town for a horse racing location in the town of Plymouth all
4040 9of the following conditions shall be met prior to any licensing application or such location being
4141 10considered by the gaming commission:
4242 11 (1) the town shall publish notice of the proposed horse racing location at least 60 days
4343 12prior to any public hearing on the proposed horse racing location;
4444 13 (2) a public hearing on the proposed horse racing location shall be held in the town no
4545 14less than 30 days before the next scheduled town meeting;
4646 15 (3) a majority of the registered voters of the town of Plymouth, voting on whether to
4747 16grant a horse racing license for the proposed horse racing location, have voted in the affirmative;
4848 17 (4) the horse racing location is approved at a town meeting;
4949 18 (5) all of the conditions in clauses 1 through 4 are accomplished in the same calendar
5050 19year.
5151 20 (c) The select board of the town of Plymouth shall approve the proposed horse racing
5252 21location upon the completion of the conditions described in subsection (b).
5353 22 (d) Upon approval by the town of Plymouth pursuant to subsections (b) and (c), the
5454 23gaming commission may consider the approved horse racing location for use in horse racing
5555 24pursuant to chapter 128A of the General Laws.
5656 25 SECTION 4. This act shall take effect upon its passage
