30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION I. The purpose of this legislation is to ensure that the citizens of Plymouth |
---|
33 | 33 | | 2have the opportunity to decide whether horse racing shall be licensed in their town. |
---|
34 | 34 | | 3 SECTION 2. For the purpose of this act, "horse racing" shall mean every meeting where |
---|
35 | 35 | | 4horses are raced and where any form of betting or wagering on the speed or ability of horses is |
---|
36 | 36 | | 5permitted. |
---|
37 | 37 | | 6 SECTION 3. (a) Except as provided in this section there shall be no horse racing in the |
---|
38 | 38 | | 7town of Plymouth. 2 of 2 |

39 | 39 | | 8 (b) Upon application to the town for a horse racing location in the town of Plymouth all |
---|
40 | 40 | | 9of the following conditions shall be met prior to any licensing application or such location being |
---|
41 | 41 | | 10considered by the gaming commission: |
---|
42 | 42 | | 11 (1) the town shall publish notice of the proposed horse racing location at least 60 days |
---|
43 | 43 | | 12prior to any public hearing on the proposed horse racing location; |
---|
44 | 44 | | 13 (2) a public hearing on the proposed horse racing location shall be held in the town no |
---|
45 | 45 | | 14less than 30 days before the next scheduled town meeting; |
---|
46 | 46 | | 15 (3) a majority of the registered voters of the town of Plymouth, voting on whether to |
---|
47 | 47 | | 16grant a horse racing license for the proposed horse racing location, have voted in the affirmative; |
---|
48 | 48 | | 17 (4) the horse racing location is approved at a town meeting; |
---|
49 | 49 | | 18 (5) all of the conditions in clauses 1 through 4 are accomplished in the same calendar |
---|
50 | 50 | | 19year. |
---|
51 | 51 | | 20 (c) The select board of the town of Plymouth shall approve the proposed horse racing |
---|
52 | 52 | | 21location upon the completion of the conditions described in subsection (b). |
---|
53 | 53 | | 22 (d) Upon approval by the town of Plymouth pursuant to subsections (b) and (c), the |
---|
54 | 54 | | 23gaming commission may consider the approved horse racing location for use in horse racing |
---|
55 | 55 | | 24pursuant to chapter 128A of the General Laws. |

56 | 56 | | 25 SECTION 4. This act shall take effect upon its passage |
