| 27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 28 | 28 | | of the same, as follows: |
|---|
| 29 | 29 | | 1 Section 57 of chapter 71 of the General Laws, as appearing in the 2020 Official Edition, |
|---|
| 30 | 30 | | 2is hereby amended by adding the following paragraph:- |
|---|
| 31 | 31 | | 3 If a child receives a deficient or failing assessment following any health examination |
|---|
| 32 | 32 | | 4conducted pursuant to this section, the person who conducted the examination or the school shall |
|---|
| 33 | 33 | | 5notify the parent or guardian of the child within 1 week of the date of the deficient or failed |
|---|
| 34 | 34 | | 6examination, prior to any subsequent assessment. The school shall notify the parent or guardian |
|---|
| 35 | 35 | | 7of a child who has received a deficient or failing assessment of the results of any subsequent |
|---|
| 36 | 36 | | 8assessment, regardless of the outcome of the subsequent assessment. Notification pursuant to this |
|---|
| 37 | 37 | | 9paragraph shall include: (i) the date of the screening; (ii) the name and address of the child; (iii) |
|---|
| 38 | 38 | | 10the name of the child’s school; (iv) the type of examination; (v) a summary of significant |
|---|
| 39 | 39 | | 11findings, including any follow-up measures planned by the school; (vi) information regarding |
|---|
| 40 | 40 | | 12educational assistance, where warranted; and (vii) the name, address and signature of the person 2 of 2 |
|---|
| 41 | 41 | | 13who conducted the examination. Notification pursuant to this section shall be written in English |
|---|
| 42 | 42 | | 14and, where possible, the parent or guardian’s primary language. |
