33 | 33 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
34 | 34 | | of the same, as follows: |
---|
35 | 35 | | 1 Be it hereby resolved that the Legislature of the Commonwealth of Massachusetts enact |
---|
36 | 36 | | 2this Home Rule Petition to allow the City of Medford the authority to require the adoption of |
---|
37 | 37 | | 3institutional master plans subject to the review and approval by the municipality provided, that |
---|
38 | 38 | | 4the Legislature may reasonably vary the form and substance of the requested legislation within |
---|
39 | 39 | | 5the scope of the general public objectives of this petition. |
---|
40 | 40 | | 6 Section 1. The purpose of this legislation is to promote and facilitate the coordinated and |
---|
41 | 41 | | 7predictable development of larger-scale institutional facilities. The legislation permits the City |
---|
42 | 42 | | 8to require the adoption of an institutional master plan, as described below in Section 2. An 2 of 2 |
---|
43 | 43 | | 9institutional master plan is a land-use and development plan for all land owned or used by an |
---|
44 | 44 | | 10institution within a community, that identifies growth and development over a number of years, |
---|
45 | 45 | | 11or in several phases. The master plan provides a tool to assure the community that strategies and |
---|
46 | 46 | | 12development impacts are addressed through the review and adoption of the plan, while providing |
---|
47 | 47 | | 13predictable outcomes for any planned growth of the institution. |
---|
48 | 48 | | 14 Section 2. Notwithstanding G. L. c. 40A, ยง 3 or other applicable law, the City of |
---|
49 | 49 | | 15Medford is hereby authorized to adopt local legislation imposing institutional master plan review |
---|
50 | 50 | | 16to regulate the use of land or structures for land owned, leased or otherwise occupied by |
---|
51 | 51 | | 17hospitals, health care institutions, colleges, universities, and non-profit educational corporations. |
---|
52 | 52 | | 18 Section 3. This act shall take effect upon passage. |
---|
