2828 An Act authorizing the Orleans affordable housing trust to provide for the creation and
2929 preservation of attainable housing.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Section 1 of chapter 104 of the Orleans Affordable Housing Trust Fund
3333 2Bylaw is hereby amended by inserting, in line 2, after the words, "low- and moderate-income
3434 3households", the following: "for the creation and preservation of attainable housing, as defined
3535 4below in §104-15".
3636 5 SECTION 2. And further in section 3 of said chapter by inserting, in line 2, after the
3737 6words, "Section 55C", the following: "and the purposes set forth above in §104-1".
3838 7 SECTION 3. And further in said chapter by adding the following new section:
3939 8 §104-15. Definition of Attainable Housing.
4040 9 For the purpose of this Bylaw, the term “attainable housing” shall mean housing that is
4141 10not restricted to occupancy by low- or moderate-income households, and may also include 2 of 2
4242 11housing subject to maximum income limits to be occupied by households with gross income
4343 12greater than 80 per cent but not more than 200 per cent of the area median household income as
4444 13most recently determined by the United States Department of Housing and Urban Development,
4545 14adjusted for household size.
4646 15 SECTION 4. This act shall take effect upon its passage, provided, however, that the
4747 16General Court may make clerical or editorial changes of form only to the bill, unless the Select
4848 17Board approve amendments to the bill before enactment by the General Court; and provided
4949 18further that the Select Board is hereby authorized to approve amendments which shall be within
5050 19the scope of the general public objectives of this petition, and to further authorize the Select
5151 20Board to approve the final language of any such special legislation or to take any other action
5252 21relative thereto.
