32 | 32 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
33 | 33 | | of the same, as follows: |
---|
34 | 34 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, Dennis Annear |
---|
35 | 35 | | 2a member of the Charlemont Fire Department, may continue to serve in their position until they |
---|
36 | 36 | | 3reach 68 years of age, the date of their retirement or the date they are removed or suspended |
---|
37 | 37 | | 4from office in accordance with applicable laws, rules or regulations, whichever occurs first; |
---|
38 | 38 | | 5provided, however, that they remain physically and mentally capable of performing the duties of |
---|
39 | 39 | | 6the position. If requested, Dennis Annear shall, at the expense of the Town of Charlemont, be |
---|
40 | 40 | | 7examined by an impartial physician designated by the Town of Charlemont to determine such |
---|
41 | 41 | | 8capability. No deductions shall be made from the regular compensation of Dennis Annear |
---|
42 | 42 | | 9pursuant to chapter 32 of the General Laws for any service subsequent to enactment. |

43 | 43 | | 10 SECTION 2. This act shall take effect upon its passage. |
