29	29	An Act relative to revising the Non-Public Ambulance Trust Fund.
30	30	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
31	31	of the same, as follows:
32	32	1 The secretary of the executive office of health and human services shall conduct a study
33	33	2to recommend and implement a revision of the non-public ambulance trust fund and its fee
34	34	3assessment and payment models. The study shall include:
35	35	4 (i) Review of the payment models, uniform assessment and nonpublic emergency
36	36	5ambulance assessed charges set for nonpublic ambulance service in section 67A of chapter 118E
37	37	6of the General laws.
38	38	7 (ii) The uniform assessment and payment models’ fiscal effect on regionalized
39	39	8emergency-only, non-profit ambulance services with no Medicaid patients.
40	40	9 (iii) The uniform assessment’s compliance with federal law that requires the assessments
41	41	10set forth in said section 67A be imposed in a manner consistent with applicable federal statutes
42	42	11and regulations 2 of 2
43	43	12 (iv) Efforts by the office to avoid a reduction in the state’s Medicaid expenditures eligible
44	44	13for federal financial participation in relation to the assessments and payment models forth in said
45	45	14section 67A.
46	46	15 (v) A review of enforcement mechanisms regarding each nonpublic ambulance service's
47	47	16liability to the fund in the event that a nonpublic ambulance service does not make a scheduled
48	48	17payment to the fund.
49	49	18 The study shall be conducted in consultation with interested parties. The secretary shall
50	50	19file a report with the clerk of the house of representatives on or before June 30, 2024 describing
51	51	20the findings of this study, and shall recommend to the general court revisions or amendments to
52	52	21the fund and its assessment and payment models, including whether these revisions would serve
53	53	22to promote regionalized emergency-only, non-profit ambulance services. The clerk shall forward
54	54	23such report to the joint committee on health care and the joint committee on health care financing
55	55	24of the general court.
