2929 An Act relative to revising the Non-Public Ambulance Trust Fund.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 The secretary of the executive office of health and human services shall conduct a study
3333 2to recommend and implement a revision of the non-public ambulance trust fund and its fee
3434 3assessment and payment models. The study shall include:
3535 4 (i) Review of the payment models, uniform assessment and nonpublic emergency
3636 5ambulance assessed charges set for nonpublic ambulance service in section 67A of chapter 118E
3737 6of the General laws.
3838 7 (ii) The uniform assessment and payment models’ fiscal effect on regionalized
3939 8emergency-only, non-profit ambulance services with no Medicaid patients.
4040 9 (iii) The uniform assessment’s compliance with federal law that requires the assessments
4141 10set forth in said section 67A be imposed in a manner consistent with applicable federal statutes
4242 11and regulations 2 of 2
4343 12 (iv) Efforts by the office to avoid a reduction in the state’s Medicaid expenditures eligible
4444 13for federal financial participation in relation to the assessments and payment models forth in said
4545 14section 67A.
4646 15 (v) A review of enforcement mechanisms regarding each nonpublic ambulance service's
4747 16liability to the fund in the event that a nonpublic ambulance service does not make a scheduled
4848 17payment to the fund.
4949 18 The study shall be conducted in consultation with interested parties. The secretary shall
5050 19file a report with the clerk of the house of representatives on or before June 30, 2024 describing
5151 20the findings of this study, and shall recommend to the general court revisions or amendments to
5252 21the fund and its assessment and payment models, including whether these revisions would serve
5353 22to promote regionalized emergency-only, non-profit ambulance services. The clerk shall forward
5454 23such report to the joint committee on health care and the joint committee on health care financing
5555 24of the general court.
