31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
32 | 32 | | of the same, as follows: |
---|
33 | 33 | | 1 SECTION 1. Notwithstanding the provisions of section 5 of chapter 44B of the |
---|
34 | 34 | | 2Massachusetts General Laws, the town of Wellesley, upon recommendation of its community |
---|
35 | 35 | | 3preservation committee, is hereby authorized to appropriate or expend community preservation |
---|
36 | 36 | | 4funds to the Wellesley Housing Authority, an independent body politic and corporate established |
---|
37 | 37 | | 5pursuant to chapter 121B of the Massachusetts General Laws, for the acquisition, creation, |
---|
38 | 38 | | 6preservation, rehabilitation or restoration, and support of community housing, as such terms are |
---|
39 | 39 | | 7defined in said chapter 44B. |
---|
40 | 40 | | 8 SECTION 2. Funds appropriated or expended for the rehabilitation or restoration of |
---|
41 | 41 | | 9community housing that was not acquired or created pursuant to said chapter 44B shall not count |
---|
42 | 42 | | 10towards the requirement in section 6 of said chapter 44B to spend, or set aside for later spending, |
---|
43 | 43 | | 11not less than a certain percent of the annual revenues for community housing. 2 of 2 |

44 | 44 | | 12 SECTION 3. The town shall not appropriate or expend any funds for the rehabilitation or |
---|
45 | 45 | | 13restoration of community housing that was not acquired or created pursuant to said chapter 44B |
---|
46 | 46 | | 14that were set aside for later spending on community housing projects under section 6 of said |
---|
47 | 47 | | 15chapter 44B. |
---|
48 | 48 | | 16 SECTION 4. The town of Wellesley, acting by and through its community preservation |
---|
49 | 49 | | 17committee, shall execute a grant agreement with the Wellesley Housing Authority concurrent |
---|
50 | 50 | | 18with any appropriation and expenditure of funds under this Act to ensure that all community |
---|
51 | 51 | | 19preservation funds are expended appropriately. |
---|
52 | 52 | | 20 SECTION 5. This Act shall take effect upon its passage. |
