2929 An Act facilitating the appropriation and expenditure of community preservation funds for
3030 community housing purposes in the town of Wellesley.
3131 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3232 of the same, as follows:
3333 1 SECTION 1. Notwithstanding the provisions of section 5 of chapter 44B of the
3434 2Massachusetts General Laws, the town of Wellesley, upon recommendation of its community
3535 3preservation committee, is hereby authorized to appropriate or expend community preservation
3636 4funds to the Wellesley Housing Authority, an independent body politic and corporate established
3737 5pursuant to chapter 121B of the Massachusetts General Laws, for the acquisition, creation,
3838 6preservation, rehabilitation or restoration, and support of community housing, as such terms are
3939 7defined in said chapter 44B.
4040 8 SECTION 2. Funds appropriated or expended for the rehabilitation or restoration of
4141 9community housing that was not acquired or created pursuant to said chapter 44B shall not count
4242 10towards the requirement in section 6 of said chapter 44B to spend, or set aside for later spending,
4343 11not less than a certain percent of the annual revenues for community housing. 2 of 2
4444 12 SECTION 3. The town shall not appropriate or expend any funds for the rehabilitation or
4545 13restoration of community housing that was not acquired or created pursuant to said chapter 44B
4646 14that were set aside for later spending on community housing projects under section 6 of said
4747 15chapter 44B.
4848 16 SECTION 4. The town of Wellesley, acting by and through its community preservation
4949 17committee, shall execute a grant agreement with the Wellesley Housing Authority concurrent
5050 18with any appropriation and expenditure of funds under this Act to ensure that all community
5151 19preservation funds are expended appropriately.
5252 20 SECTION 5. This Act shall take effect upon its passage.
