maintenance of the departments, boards, commissions, institutions and certain activities of the
Commonwealth, for interest, sinking fund and serial bond requirements and for certain
permanent improvements (see House, No. 4040), which had been returned by Her Excellency the
Governor with recommendation of amendment (for message see Attachment D of House, No.

An Act relative to the distribution of alcoholic beverages consumed in gaming establishments
not within gaming areas.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
the distribution of alcoholic beverages consumed in gaming establishments not within gaming
areas, therefore it is hereby declared to be an emergency law, necessary for the immediate
preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. Section 26 of chapter 23K of the General Laws, as so appearing, is hereby
2amended by inserting after the word “commission”, in line 37, the following words:- ; provided,
3however, that the division of gaming liquor enforcement of the alcoholic beverages control
4commission, in consultation with the commission, shall, for violations of said chapter 138,
5enforce, regulate and control the distribution of alcoholic beverages to be drunk in a gaming
6establishment but not within a gaming area, including, but not limited to, restaurants and bars.
